Do you have a valid Will?
A Will is the only document which has legal effect after you die. If you care about what happens after you die, then it is very important to have a Will and to keep it up to date. It is particularly important to have a Will if you have young children.
If you do not have a Will or if your Will is badly drafted then you hugely increase the risk of a dispute between the loved ones you leave behind. This dispute may destroy precious family relationships you have worked a life-time to build.
A Will is very important, but it can also be a very simple and inexpensive document.
Have you been left out of a Will or is the amount left to you unfair?
Wills can be challenged. If you have been left out of a Will, or if your share is not adequate you may have the right to make a claim on the estate for a larger share under the Family Provision Act 1982. We can advise you whether you have a right to make a claim, and if so what your prospects of success will be. If you do have a right to make a claim and would like to make it we can vigorously pursue your claim through the Courts.
Are you the Executor of an estate and need some advice about what to do?
Being an executor is a big responsibility. It is a responsibility that may have fallen to you at a time when you are grieving the loss of a loved one. We can advise you about what your responsibilities are and we can help you carry them out.
We can help you to get Probate and to administer the estate according to the Will. There are often tax and accounting issues which arise, which we can help you with, and we can recommend accountants and tax specialists if you need them.
Do you want to set up a Trust?
Trusts, are most commonly set up for tax reasons or to protect assets from creditors. There are various different types. We can advise you whether a Trust would be of benefit to you, and if it would, we can draft the documents you need and set the Trust up for you.
Trusts can also be set up as part of your Will (ie a testamentary trust). These sorts of trusts are often used to ensure young children are provided for until they are old enough to inherit.
